The Historical Background of the Public Service Commission.

During the period when Sri Lanka was a colony of the British Empire, the Public Service Commission was established under the Ceylon (Constitution) Order of May 15, 1946. This entrusted the executive powers of the appointments, promotions, transfers, disciplinary control and dismissal of public officers to the Public Service Commission.

With the adoption of the first Republican Constitution in 1972, the Public Service Commission, which functioned independently for 26 years, was abolished and the authority over the public service was vested with the Cabinet of Ministers.

In 1978, the Second Republican Constitution was restored by the Public Service Commission and the appointment of members to the Commission was made by the President in terms of Article 56 (1) of the above Article. The Public Service Commission functioned as the delegated power of the Cabinet of Ministers.

In 1978, the powers of appointments, promotions, transfers, disciplinary control and dismissal of public officers were vested in the Public Service Commission by the Secretaries to the Ministries and Heads of Departments in accordance with the Cabinet Decisions. The Public Service Commission functioned as the Appeal Appreciate. [See Article 58 (1) & 58 (2) of the Constitution).

Later, in 1992, the Cabinet of Ministers delegated the powers of appointments, promotions, transfers, disciplinary control and dismissal of staff grades of staff grades who had been entrusted to the Secretaries to the Ministries. According to the Article 54 (1) amended by the 18th Amendment to the Constitution, the Public Service Commission consists of nine members appointed by the President. The President appoints one of these members as the Chairman of the Commission. They hold office for a term of validity of three years, and are eligible for re-appointment for such a period. According to the Article 55 (1) amended by the 18th Amendment, the Cabinet of Ministers shall make provision for all policy matters pertaining to public officers. Subject to the provisions of the Constitution, the Commission is entrusted with the powers of appointment, promotion, transfer and disciplinary control of public officers, including the police.
