The Historical Background of the Public Service Commission.

During the period when Sri Lanka was a colony of the British Empire, the Public Service Commission was established under the Ceylon (Constitution) Order of May 15, 1946. This entrusted the executive powers of the appointments, promotions, transfers, disciplinary control and dismissal of public officers to the Public Service Commission.

With the adoption of the first Republican Constitution in 1972, the Public Service Commission, which functioned independently for 26 years, was abolished and the authority over the public service was vested with the Cabinet of Ministers.

In 1978, the Second Republican Constitution was restored by the Public Service Commission and the appointment of members to the Commission was made by the President in terms of Article 56 (1) of the above Article. The Public Service Commission functioned as the delegated power of the Cabinet of Ministers.

In 1978, the powers of appointments, promotions, transfers, disciplinary control and dismissal of public officers were vested in the Public Service Commission by the Secretaries to the Ministries and Heads of Departments in accordance with the Cabinet Decisions. The Public Service Commission functioned as the Appeal Appreciate. [See Article 58 (1) & 58 (2) of the Constitution).

Later, in 1992, the Cabinet of Ministers delegated the powers of appointments, promotions, transfers, disciplinary control and dismissal of staff grades of staff grades who had been entrusted to the Secretaries to the Ministries. The Cabinet of Ministers has been vested with the Cabinet to change, suspend or abrogate Decisions taken by a delegated power delegated by the Commission or by it.

In the year 2001, the Chapter IX of the Constitution was repealed by the 17th Amendment to the Constitution, which was repealed and included a new chapter. Accordingly, the Public Service Commission consisted of nine members appointed by the President on the recommendation of the Constitutional Council and on the recommendation of the Constitutional Council the President appointed one of those members to be appointed as the Chairman of the Commission. The powers vested in the Public Service Commission subject to the provisions of the Constitution, vested with the Cabinet of Ministers for the Appointment, Promotion, Transfer and Discipline of the Public Service, were subject to a drastic change in the status of the Public Service Commission. The Public Service Commission It was assigned. In addition, the Public Service Commission became a responsible and answerable institution to the Parliament in accordance with Standing Orders of Parliament.

In 2010, the matters pertaining to the establishment and functions of the Public Service Commission were amended by the 18th Amendment to the Constitution. This is a Commission which should answer to Parliament in accordance with the Standing Orders of the Parliament. According to the Article 54 (1) amended by the 18th Amendment to the Constitution, the Public Service Commission consists of nine members appointed by the President. The President appoints one of these members as the Chairman of the Commission. They hold office for a term of validity of three years, and are eligible for re-appointment for such a period. According to the Article 55 (1) amended by the 18th Amendment, the Cabinet of Ministers shall make provision for all policy matters pertaining to public officers. Subject to the provisions of the Constitution, the Commission is entrusted with the powers of appointment, promotion, transfer and disciplinary control of public officers, including the police.
